About John Holloway, Jr.
John Holloway Jr., son of John Holloway Sr. and Hannah Spiers, was born by at least 12 Aug. 1716, presumably near Occupacia Creek in Essex County. He married Elizabeth Robinson in Goochland/Cumberland County. Elizabeth was the daughter of John Robinson Sr. (c. 1690–1768) and Tabitha Jones of Henrico and Goochland/Cumberland counties. (The Robinson surname for this family is often confused with Robertson. John Robinson Sr. of Goochland/Cumberland counties was the son of Thomas Robinson of Henrico County.) John Jr. died in Cumberland County before 22 Sep. 1755. After his death, his widow Elizabeth married Daniel Hogan.
John Jr.'s approximate date of birth follows from the fact that he was granted tax-exempt status in Caroline County on 12 Aug. 1737. John must have been 21 to have been given such an exemption, and thus born by 1716. The following entry appears in the Caroline County Order Books on 12 Aug. 1737: "On the motion of John Holloway it's ordered John Holloway jr. be levy free" (Caroline County Order Book, 1732 – 1740, 439; see Dorman, Caroline County Order Book, 1732 – 1740, Part Two 1734/5 – 1737: 102). A similar exemption appears 16 years later on 26 Mar. 1753 for John Holloway Jr. in Cumberland County: "On his petition, John Holloway, junr. is discharged by the court from payment of Public and County Levies for the future" (Cumberland County Court Order Books 1749 – 1756: 64; see Fretwell, Cumberland County Court Order Books, 1749 – 1756, 111). This exemption in Cumberland County was granted two and a half years before John Jr.'s death.
The first evidence that John Holloway Jr. was in Goochland/Cumberland County was in his father's household for the Goochland County personal property tax lists of 1746 and 1747. These lists included John Holloway, John Holloway Jr., and William Holloway (Lurvey, Goochland County Tithe Lists 1: 5, 13).
John Holloway (Jr.) died in Cumberland County before 22 Sep. 1755. The following entries appear in court records on that date:
On the motion of Elizabeth Holloway, certificate is granted her for obtaining Letters of Administration of the Estate of John Holloway, deceased, giving security with John Robinson and Field Robinson.
Ordered that John Merryman, Jacob Winfrey, Richard Murry and William Bond do appraise the slaves, if any, and Personal Estate of John Holloway, deceased (Cumberland County Order Book 3, 1752 – 1758: 327; see Fretwell, Cumberland County Court Order Books, 1749 – 1756, 189).
Elizabeth Holloway was the apparent widow of John Holloway Jr. The John Robinson mentioned here as posting security for Elizabeth was either her father John Robinson Sr. or her brother John Jr. The Field Robinson mentioned here was Elizabeth's brother.
An inventory and appraisement of the estate of John Holloway (Jr.) deceased was filed with the court on 24 Nov. 1755. The estate papers were submitted to the court by John Merryman, Wm. Bond, and Richd. Murry (Cumberland County Will Book 1, 1749 – 1769: 110–11; see Reynolds, Cumberland County Will Book I and II, 10).
After being widowed from John Holloway Jr., Elizabeth Robinson Holloway married Daniel Hogan. John Robinson Sr. named Elizabeth Hogan as his daughter in his will of 1767, as well as naming John (Jr.), Field, Joseph and Hezekiah among his sons. Joseph and Hezekiah Robinson are named below in connection with the orphans of John Holloway Jr. There is no record of the three Holloway orphans being given into the guardianship of Daniel Hogan, though he was clearly acting in this official capacity as of 28 Jan. 1760. This may have happened by default when Daniel and Elizabeth were married sometime between 1755 and 1760. Daniel Hogan seems to have been widowed with young children before marrying Elizabeth.
"Daniel Hogan Guardian of Sarah Phebe and Drusilla Holloway orphans of John Holloway dec'd" presented accountings of the estates of the three orphans to the court in January 1760, August 1760, August 1761, November 1762, September 1763, and October 1764. Then the following two entries appear in the court record on 27 Aug. 1764:
Sarah Holloway orphan of John Holloway dec'd with approbation of the court made choice of Hezekiah Robinson to be her guardian.
Phebe Holloway orphan of John Holloway dec'd with approbation of the court made choice of Joseph Robinson to be her guardian.
In the next court session of 24 Sep. 1764, the following two entries appear:
Sarah Holloway orphan of John Holloway dec'd having at the last court chose Hezekiah Robinson to be her guardian the said Hezekiah this day with Edward Mosby his security entered into bond with condition for securing the said orphans estate and endemnifying the court.
Phebe Holloway orphan of John Holloway dec'd having at the last court chose Joseph Robinson to be her guardian the said Joseph this day with William Holland & Joseph Fuquay his securitys entered into bond with condition for securing the said orphans estate and endemnifying the court.
Two years later, the following two entries appear for 25 Aug. 1766:
Hezekiah Robinson & Joseph Robinson guardians of Sarah & Pheby Holloway orphans of John Holloway dec’d presented an account of the profits of the said orphans estate to which they made oath of the same being examined and approved of by the court is ordered to be recorded.
Hezekiah Robinson is appointed guardian of Drucilla Holloway orphan of John Holloway dec'd whereupon he with Joseph Robinson and William Holland his securitys entered into bond according to law.
On 25 Feb. 1771, the following entry appears in the court record:
Sarah Holloway orphan of John Holloway deceased came into court and with the approbation of the court chose Daniel Sanders to be her guardian whereupon the said Daniel with Simon Hughes his security entered into bond according to law.
Sarah Holloway, orphan of John Holloway Jr. married her guardian Daniel Sanders/Saunders before 25 Nov. 1771. Sarah's two sisters had already married as of that time. On that date a lawsuit arose among the three daughters of John Holloway Jr. concerning the division of their inheritance. Phebe Holloway Puckett and Drucilla Holloway Hannaken, together with their husbands, filed suit against Sarah Holloway Saunders and her husband, and also against Hezekiah and Joseph Robinson. The court entry reads in part as follows:
After reading the will of John Holloway (Sr.), the court divided 275 acres among the three daughters of his son John Jr. The division was to be made equally by the county surveyor, George Keeling, Benjamin Wilson, and John Jefferson, gentlemen, or any three, whereof the county surveyor was to be one. Also, the same gentlemen were to administer the sale of the slave Cornwall at public auction, the proceeds being equally divided among the three heirs (Cumberland County Order Book 8, 1770 – 1772: 372–73).
In addition to appearing in the Cumberland County Order Books, the suit among the three daughters of John Holloway Jr. and Elizabeth Robinson also appears in Cumberland County Chancery Court records. The chancery records of November Court 1771 begin as follows:
To the worshipful Court of Cumberland County sitting in Chancery
Humbly complaining unto your worships your oratrixes Jeremiah Pucket & Phebe his wife & Hugh Flannakin & Drucilla his wife which said Phebe & Drucilla are granddaughters of and devises under the last will and testament of John Holloway late of Cumberland County dec'd that the said John Holloway dec'd being seized and possessed of a tract of land in the said county containing (blank) acres on the thirteenth day of December 1757 duly made and published his last will and testament in writing wherein he gave and bequeathed to his son John Holloways three daughters to wit Sarah since married to Daniel Saunders & your (??? ???) Phebe and Drucilla two hundred and seventy five acres of land in this county… (followed by a description of the land) (Library of Virginia Chancery Database, Cumberland County Case # 1772_011, Jeremiah Puckett and wife ETC vs Daniel Saunders ETC, Image 2).
On 27 Apr. 1772, Daniel Saunders and Sarah (Holloway) his wife sold Sarah's inheritance of 91 acres to Alexander Trent, both parties of Cumberland County. The consideration was 33 pounds, 6 shillings, 8 pence. The tract of 91 acres was described in the deed as follows:
being one third of a tract of land devised by John Holloway late of the sd county deceased by his last will and testament of record in the county court of Cumberland aforesaid to his son John Holloway’s three daughters, viz, Sarah, Phebe, Drucilah, one of which sd daughters is the sd Sarah, party hereto, which said land so devised was divided between the said Sarah, Phebe, and Drucila and the said ninety one acres within the bounds hereafter mentioned was allotted to the said Sarah as her dividend thereof…
The property adjoined Alexander Trent, Phebe, wife of Jeremiah Pucket, John Bradley, John Holland, and James Anderson. (Drucilla was spelled as Drucila and Drucilah.) No witnesses were mentioned (Cumberland County Deed Book 5, 1771 – 1778: 39–40).
On 24 Aug. 1772, Jeremiah Pucket and Phebe (Holloway) his wife of Bedford County sold Phebe's inheritance of 91 acres to Alexander Trent of Cumberland County. The consideration was 34 pounds current money of Virginia. The tract of 91 acres was described in the deed as follows:
being one third of a tract of land devised by John Holloway late of the said county deceased by his last will and testament of record in the county court of Cumberland aforesaid to his son John Holloways three daughters (viz) Sarah Phebe Drucilah one of which said daughters is the said Phebe party hereto which said land so devised was divided between the said Sarah, Phebe, and Drucilah and the said ninety one acres written the bounds hereafter mentioned was allotted to the said Phebe as her dividend thereof…
The property adjoined Alexander Trent, Drucilah, wife of Hughes Hannakin, John Bradley, and Sarah, wife of Daniel Saunders. (The deed refers to Hughes Hannakin and Hughes Hannaken.) No witnesses were mentioned (Cumberland County Deed Book 5, 1771 – 1778: 89–90).
On 22 Mar. 1773, Hughes Hannakin alias Hugh Hannakin and Drucilla (Holloway) his wife of North Carolina sold Drucilla's inheritance of 91 acres to Alexander Trent of Virginia. The consideration was 40 pounds current money of Virginia. The tract of 91 acres was described in the deed as follows:
being one third of a tract of land devised by John Holloway late of the said county deceased by his last will and testament of record in the county court of Cumberland aforesaid to his son John Holloways three daughters (viz), Sarah, Phebe, Drucilla, one of which said daughters is the said Drucilla party hereto which said land so devised was divided between the said Sarah, Phebe and Drucilla and the said ninety one acres within the bounds hereafter mentioned was allotted to the said Drucilla as her dividend thereo…
The property adjoined Alexander Trent, John Bradley, and Phebe, wife of Jeremiah Pucket. No witnesses were mentioned (Cumberland County Deed Book 5, 1771 – 1778: 147–48). Note that this deed for Drucilla Holloway Hannakin spells her name throughout as Drucilla.
Upon leaving Cumberland County, Daniel Hogan and his wife Elizabeth seem to have moved to Burke Co., NC. Daniel seems to have died there. The whereabouts of his wife Elizabeth Robinson Holloway Hogan remain unclear. Daniel may have married a third time after her death. Research for Drucilla Holloway and her husband Hughes Hannakin in North Carolina might yield more information for Drucilla's mother and stepfather. Jeremiah Puckett and his wife Phebe Holloway left Cumberland to move to Bedford County, where they lived next door to Phebe's uncle William Holloway Sr. and aunt Frances Meador. Daniel Saunders seems to have been Daniel Saunders, orphan of Richard Saunders, in account with James Brown (guardian) in 1762, 1764, and 1765. Daniel's orphan sister Nancy Saunders was in account with Thomas Montague (guardian).
