Note: James and Sarah lived on Richland Creek in Guilford County, North Carolina.

He was given a land grant in 1753 in North Carolina; he received 420 acres of land under an English grant by King George II. He willed this land to his son, James Jr., 18 October 1765.

James received this land grant from Granville. The land was on the South side of the Reedy Fork of Haw River and on both sides of Richland Creek.

James, the settler, is the third of the Pennsylvania-North Carolina group. He lived according to family tradition in Pennsylvania before going to North Carolina. Tradition relates that the name was formerly spelled with a "Q" and was changed to "C" at the suggestion of Dr. David Caldwell. James first settled in Pennsylvania. He was associated with the Nottingham Company.

James will can be found in Salisbury, Rowan County, North Carolina. Will Book A, 1766 July Court. The will is as follows:

In the name of God Amen. I James McCuistion in the province of North Carolina and county of Rowan being infirm in Body but of sound Memory and Judgment do this eighteenth day of October in the Year of our Lord God one thousand seven hundred and sixty five make and publish this my last Will and Testament whether by word or writing if such be made by me.

First I bequeath my Soul to God, waiting through Grace in Christ my saviour for the merit promised to them that believe in him and my Body to be interred as my Executors think fit, and first of all pay my just Debts and to divide my Estate as follows to wit.

First of all I give to my dearly beloved wife Jenut McCuistion the full third part of all my moveables with my ready Moneys and debts due to me with my Negro Fellow named Gim or James. Secondly, with my plantation I now live on during her lifetime not to be disturbed by any to have the same power as if I was alive.

2nd. Secondly, I give the Remainder of all my moveables and Chattels to my five Daughters to be equally divided amongst them to my Daughter Jane now maryd to Thomas Flack, also my Daughter Sarah, also to my Daughter Levina now maryd to John Nelson, also to my Daughter Mary, and to my Daughter Dorcas.

3rd. Thirdly, I give to my son Gustavus McCuistion I give four hundred and forty acres of Land lying on both Sides of Rich Land Creek known by the name of the Mill place joining Scots Land. I allow and ordain Son Thomas McCuistion as Guardian over him and not to sell or dispose of the plantation I left to my Son Gustavus McCuistion without my Son Thos. McCuistion's Consent or Leave by the Name of the Mill place.

4th. Fourthly, I give to my Son James McCuistion the plantation I now live on with all the improvements and piece or parcel of Land as is contained in said Deed for said Improvement at his Mother my Wife's Death and not to then and not to molest her or any she appoints to live on it during her Lifetime.

5th. I allow unto my son Thos. McCuistion the Sum of twenty Shills (current Money of North Carolina) to be paid in three months after my Decease to be paid by my Son James McCuistion.

6th, I allow unto my Son Thos. McCuistion [and] Son James McCuistion the sum of nine pounds to be paid when is come of age by my Son James McCuistion.

7th. I allow my son James McCuistion to pay unto my three Daughters, Sarah, Dorcas, and Mary, each of them twenty pounds and to be paid in four years after their Mother's Decease, my wife Jennut McCuistion, also allow my wife Jennet McCuistion and my son Thos. McCuistion and my son James McCuistion, Executors of this my last will and Testament, in the presence of us who were present at the signing and sealing of the Day & Year above written.

The Nottingham Colony was a group of people who came to the area from the Nottingham Presbyterian Church in Rising Sun, Lancaster County, PA; it was established in old Rowan County, North Carolina.
